[IAC#RG] DRAFT response for UCC questionaire

Dear all

I am attaching below a first draft response to key clauses of Law Commission on Uniform Civil Code.

Questionnaire on Uniform Civil Code

1. Are you aware that Article 44 of the Constitution of India provides that "the State shall endeavour to secure for the citizens a Uniform Civil Code throughout the territory of India"?

a.    Yes

b.    No

YES

In your view, does this matter require any further initiatives?

Yes, it requires a final judicial pronouncement from the Supreme Court. The clear meaning of this clause ("endeavour") is that this principle is an unattainable goal and hence directionary, and thereby unenforceable, in nature. This principle first requires that States like J&K be incorporated within the territory of India.  For instance, there is already a common civil code in the State of Goa based on Portugese law. It is not clear if the Hon'ble Commission is suggesting that this Civil Code for Goa be extended throughout the territory of India or if the Civil Code of Goa shall be scrapped ?  It is also not clear how any Uniform Civil Code will be applied to certain states of India (eg. J&K, the North-East etc.) without a referendum on the issue and if the Hon'ble Commission proposes that the Uniform Code can be applied in a piecemeal fashion.


4. Will uniform civil code or codification of personal law and customary practices ensure gender equality?

a.    Yes

b.    No


This is an exceptionally poorly worded question. The Hindu Bahujan Raksha Dal questions the competence of the fools who have drafted this query requiring a single answer to a compound query. Accordingly, under the Roman maxim "Falsus in uno, falsus in omnibus" we are caused to reply as NO.

 

5. Should the uniform civil code be optional?

a.    Yes

b.    No

 

YES. The State cannot, and must not, interfere with the religious practices of its people.

 

6.    Should the following practices be banned and regulated?

a.    Polygamy (Banned/ Regulated)

b.    Polyandry (Banned/ Regulated)

c.    Similar customary practices such as Maitri-karaar (friendship deed) et al. (Banned/ Regulated)

 

6a: NO, this is a religious practice and out of scope of UCC legislation

6b. NO, this is a religious practice and out of scope of UCC legislation

6c. YES, Maitri Karar (and its variants) must be banned because it is a civil contract and hence amenable to UCC legislation.

 

7.    Should the practice of triple talaq be

a.    Abolished in toto.

b.    Retained the custom

c.    Retained with suitable amendments

 

We again criticise the poorly drafted query. We say Triple Talaq must be RETAINED and its benefits EXTENDED to all COMMUNITIES:

Triple Talaq is an Islamic  religious practice. It is highly beneficial and practical for all parties concerned. The alternative to 'Triple Talaq' are protracted, expensive and traumatic judicial proceedings where the only beneficiaries are the lawyers and judges. There is already a universal secular marriage law and divorce law in India (Special Marriage Act) for those who opt for it, and there is no bar for Muslims to marry and divorce under this act. Solemnisation / Registration of marriages under Special Marriage Act rules out Triple Talaq divorces.

 

8.    Do you think that steps should be taken to ensure that Hindu women are better able to exercise their right to property, which is often bequeathed to sons under customary practices?

a.    Yes, Hindu women must be made aware of this right and measures should be taken to ensure that women, under pressure from family do not forego their property.

b.    No there are adequate protections in the existing law.

c.    Legal provisions will not help in what is primarily a cultural practice, steps have to be taken so sensitise the society instead.

 

YES. We suggest that the entire gender insensitive and biased Hindu Code of 1955-56 era should be scrapped in its entireity.

 

9.    Do you agree that the two-year period of wait for finalising divorce violates Christian women's right to equality?

a.    Yes, it should be made uniform across all marriages

b.    No. This period is sufficient and in-keeping with religious sentiments.

 

YES: It is a very sound principle, gender friendly, and should be made uniform across all marriages. Furthermore, many religions believe that marriage being a sacrament does not permit any divorce.

 

10.    Do you agree that there should be a uniform age of consent for marriage across all personal laws and customary practices?

a.    Yes.

b.    No, customary laws locate this age at the attainment of puberty.

c.    The prevailing system of recognising 'voidable' marriages is sufficient.

YES : Furthermore, we say that the minimum statutory age for marriage in all communities should be kept at 25 years for males and 21 years for women, and there must be compulsory registration of marriages to be done within 30 days.

 

11.    Do you agree that all the religious denominations should have the common grounds for divorce?

a.    Yes

b.    No, cultural difference must be preserved.

c.    No, but there should be the same grounds for divorce available for men and women within personal law.

12.    Would uniform civil code aid in addressing the problem of denial of maintenance or insufficient maintenance to women upon divorce?

a.    Yes

b.    No

Give reasons:

 

NO: This aspect should be addressed under the Criminal Code and maintenance should be provided by the socialist State directly under section 125 CrPC or otherwise.

 

13. How can compulsory registration of marriages be implemented better?

 

There is no law of India requiring compulsory registration of marriages. To implement compulsory registration of Hindu marriages, the entire Hindu Code of 1955-56 era should be scrapped / repealed as these are biased and gender unfriendly.

 

 

14. What measures should we take to protect couples who enter into inter-religion and inter-caste marriages?

 

Mandate as follows:-

A)   that all such marriages be registered under Special Marriages Act

B)   that Registrants under Special Marriages Act  be given all the benefits in law available to Scheduled Castes.

 

 

15. Would uniform civil code infringe an individual's right to freedom of religion?

a.    Yes

b.    No

Give reasons:    .

YES:

1)    Many religions permit polygamy, polyandry etc which are social-cultural devices devised to propagate their religions through "breeding".

 

2)    The Hindu religion permits upto 4 wives per male. This should be retained in law.

 

3)    The Hindu religion permits Kulin marriages per male. This should be retained in law

 

4)    Since the details of any proposed UCC are not circulated, it is unfair and unreasonable to solicit queries on this issue without complete transparency.

 

5)    It seems the Law Commission is behaving in a highly biased manner by circulating such poorly designed, opaque and skewed questionnaires, and that too only among the educated elite.

 

16. What measures should be taken to sensitize the society towards a common code or codification of personal law?


Remarks:

There are a whole slew of measures we could suggest, if we were convinced that the Law Commission is serious and honest. But first, the Law Commission may clarify if it proposes to achieve a common code or whether it merely proposes to codify personal laws. To this end We strongly propose and suggest that all personal laws, and especially the entire Hindu Code of 1955-56 era be scrapped / repealed.

Do you have some idea if a patient stays in a private hospital for 2/3 weeks what will it cost only for room,nursing medicines and consultants/ Doctors fee? If surgery is involved, God forbid.


 It is for nothing That in Govt. hospitals like AIIMS, you can get a bed unless you are linked up politically. They are only to serve the Ministers and the Secrataries or linked with them. Not

add to this is the security risk in- cluding fires whether it is orissa or Calcutta. In short the medical facilities are grossly inadequete, badly managed,without any accountability. Yesterday discussion on sum hospital is totally wrong. Sum hospital is substitute for government hospital not any corporate hospitals like aditya care,appllo etc

Plz don't comment any unnecessary things this hospital is lifeline for poor sections of odisha

And another thing just 2 months before fire broke out Cuttack govt scb hospital but chief minister was not arrested neither chief medical officer

We should favor somebody's effort he is not like mallya or any black corporate person

Don't know about any other reason but the way he questions Pakistan generals and takes the questions right to the culprit's throat..
Yesterday on News Hour he insisted on knowing whereabouts of SUM hospital owner, some Nayar who runs Medical Colleges, Engg institutes and wat not in Orrisa.
These country straps have BIG money involved and can go to any length to silence ppl.
No other news channel does this so good and corners the culprit.
Hence security cover can be put to higher cat too..Well Worth.

Are you suggesting the Private Hospitals are better?. Yes in terms of facilities but at what cost? and How many people can afford it ? My first reaction is that unless this matter of collecting funds from the time of India Against corruption Jan Andolan 0f 2011among various stake holders- gets resolved amicably through dialogue it is going to get messier and involvement of the financial institutions-I.T, ED and even courts can,t be ruled out. Singly out Anna Hazare and or Kiran Bedi/Prshant Bhusan is not going to be helpful. Regds JKGaur Mumbai

We have noted that our concerns contained in our Private email communication dated 19.Sep.2016 to yourselves have not been responded to. Although one Shri Sanjay Pathare spoke with us thereafter but no definite action was taken from your side. It was also our magnanimity towards Annaji that we did not precipitate matters and waited till Annaji's biopic was released on 14.Oct.2016..


Accordingly, We are now caused to request you to clarify / resolve the past issues of our email dt. 19.Sep.2016 and the following additional issues without further delay, otherwise we shall, albeit reluctantly, have to take up these matters before the competent agencies, regulatory bodies and courts, as appropriate.

 

1)   The issue of the visit of Ms. Anjali Damania to Ralegan Siddhi on or about 01.June.2016. We are very reliably given to understand that Ms. Damania discussed at length with Annaji the new political formation / party emerging from Aam Aadmi Party being led by Team Anna's Shri Prashant Bhushan, now known as "Swaraj India" and the ways to again misuse our name of INDIA AGAINST CORRUPTION, as they did in the past to collect money from public which was neither recorded in the BVJA Nyas or the PCRF audited accounts.

 

2)   The issue of rendition of accounts to the public and the State for the Rupees TWENTY FIVE CRORE collected by way of ANNA SMS Cards / INDIA AGAINST CORRUPTION SMS Cards arranged for and sold by Annaji's employees, ie. Shri Datta Awari, Shri Suresh Pathare, Shri Dadasaheb Pathare and Shri Sanjay Pathare etc. on behalf of Ms. Kiran Bedi from about 6 April 2012 onwards. We are concerned that not only has Ms. Kiran Bedi seemingly failed to properly account to Public Cause Research Foundation (of which she is still a trustee per PCRF's website) for the Rupees TWENTY FIVE CRORE collected on sale of these NETCORE Tata-Docomo SMS cards (on basis of Rs. 25 per card for 1 crore such cards sold) but had also apparently sold another 2 crore of such SMS cards as per Annaji's own recorded statements of December 2012 later circulated on several TV channels. Correspondingly, Annaji has apparently failed to account for the monies collected by his aforementioned employees in accounts of BVJAN.  Because BVJAN's audited accounts for year ending March 2012 are not disclosed on Annaji's website, We remind you that PCRF's audited accounts for the year ending March 2012 only record income of Rs. 1.59 lakhs for these SMS cards and we would like to know if / where the balance funds collected by misusing INDIA AGAINST CORRUPTION name have been accounted for. Accordingly, we convey our apprehension that Ms. Kiran Bedi and/or Annaji's employees are collecting huge amounts of unaccounted for cash used for contesting elections and/or for financing 'Swaraj India' party. It is also very strange that the same persons who sold these SMS cards on behalf on Ms. Kiran Bedi in Uttar Pradesh and Punjab etc., and who incidentally were also made to leave from AAM AADMI PARTY, began visiting Ralegan Siddhi from 1 June 2016 onwards soon after Ms. Damania's visit and are again misusing our INDIA AGAINST CORRUPTION name to raise funds for Annaji, apparently with Annaji's blessings.

 

3)    The issue of how Annaji can repeatedly dissimulate in public that he has not touched even 5 rupees of INDIA AGAINST CORRUPTION when there is at least Rupees TWENTY FIVE CRORE which Annaji and his close associates named above have to account for to the people of India and the Revenue.

 

4)   The issue of how Annaji can repeatedly dissimulate in public that he is against political parties and politics when Annaji personally selected M/s NETCORE as service provider for the Anna-IAC SMS project knowing fully well that its owner Shri Rajesh Jain was hardcore BJP worker and close lieutenant of Shri Narendra Modi.

 

For your ready reference, we are listing a few news reports of April 2012 detailing the direct involvement of Annaji's employees in SMS Card project and that it was carried out from Ralegan Siddhi by persons impersonating as INDIA AGAINST CORRUPTION mainly in Uttar Pradesh and Maharashtra.

 

a)   NDTV: Indo-Asian News Service (Lucknow, April 06, 2012) "Team Anna launches SMS cards" quoting Vaibhav Maheshwari (described therein as an active member of Team Anna in Uttar Pradesh, but who is now UP State Spokesperson for Aam Aadmi Party) as follows "Team Anna has launched a pan-India SMS card to spread information about the campaign against corruption. One crore cards, priced at Rs.25, have been issued in the first phase and are doing brisk business in Uttar Pradesh .. Faced with fund crunch, IAC has decided to rake up the money from the supporters."

 

b)    Indian Express (Pune), April 16 2012 "Anna SMS card launched for Rs 25", "To make up for the diminishing media coverage, India Against Corruption (IAC) has now launched an SMS card with an aim to disseminate information about the organisation's campaign.. The Anna SMS card costs Rs 25, and once purchased it would keep the holder abreast with all the activities of IAC for a year" quoting Datta Avari, Anna Hazare's associate.

 

c)   Netcore.in (10 April 2012) – "Team Anna beats TRAI norms with netCORE's 90ml SMS cards" "Datta Awari, Hazare's associate in Ralegan Siddhi said, We have procured one crore cards each priced at Rs 20.The cards have been sent to Delhi and Chennai from where they will be distributed to other parts of the country"

 

d)   DNA (Daily News and Analysis) 9 April 2012 – "Now, 'Anna SMS card' will tell you what Hazare's up to"  "The cards have been sent to Delhi and Chennai from where they will be distributed to other parts. We are not going to make any profit out of selling or distributing these cards, Awari said. In Ralegan Siddhi, the distribution started on April 7, he added"

 

Accordingly, INDIA AGAINST CORRUPTION calls upon you to kindly immediately explain the situation to Shri Anna Hazare, question Shri Datta Awari and Shri Sanjay Pathare on an urgent basis, and rectify matters to our satisfaction without delay.
